Rescription, Inc. (“Company,” “we,” “us,” or “our”) values your privacy and is committed to being upfront about our privacy practices, including how we treat your personal information. 


This Privacy Policy is designed to help you understand how we collect, use and share personal information collected when you visit or use the website www.rescription.com or our mobile application, and other related sites and services (collectively, the “Site”). 


BY USING THE SITE, YOU ACCEPT AND EXPRESSLY AGREE TO OUR PRACTICES SURROUNDING THE COLLECTION, USE, AND SHARING OF PERSONAL INFORMATION (REFERRING TO ANY INFORMATION THAT RELATES TO AN IDENTIFIED OR IDENTIFIABLE INDIVIDUAL) AND NON-PERSONAL INFORMATION (REFERRING TO INFORMATION THAT DOES NOT IDENTIFY YOU AS A SPECIFIC INDIVIDUAL). PROVIDED BY YOU IN THE MANNER DESCRIBED IN THIS PRIVACY POLICY. IF YOU DO NOT AGREE WITH ANY OF THE TERMS OF THE PRIVACY POLICY, YOU ARE NOT AUTHORIZED TO ACCESS, BROWSE OR USE THE SITE IN ANY MANNER OR PROVIDE US WITH ANY OF YOUR INFORMATION.


What this Privacy Policy Covers


This Privacy Policy applies to our collection, use and sharing of your and your dependent’s personal information (collectively, “your personal information”) (a) when you visit the Site and use any services offered on or through the Site, (b) receive our communications, and (c) that we obtain from third parties.


This Privacy Policy applies only to information gathered on and through the Site or by our business partners and does not apply to any other information collected by us by other means.


Personal Information We Collect


Information You Give Us. It is our policy to only collect and use data from you that is required to use the Site and to provide services available to you in connection with the Site. As described in the Web and Mobile Terms and Conditions, we may obtain information related to your prescription benefit plan and pharmaceutical services. 


Personal information you may provide through the Site or otherwise communicate to us includes:


Registration/Account Signup Information. We may collect certain personal information including your first and last name, postal address, phone number, email, gender, date of birth, login credentials, information related to your employer, the payment of prescriptions, and prescription benefit plan and certain medical insurance plan information. 


Communications and Contact. We collect information about you (and your dependent, if applicable) when you provide contact and identity confirmation information to us via email, mail, or through the Site, including as a result of creating an account, signing up for communications, response to surveys, requesting support or any other communications. This information may include your (and your dependent’s, if applicable) first and last name, email, phone number, date of birth, location and information related to the reason for contact.


Other information. We may collect other information from you that is not specifically listed here. We may use such information in accordance with this Privacy Policy.


Information We Get From Others. We may obtain additional information about you from third party sources to provide you with more relevant information about our services. 


For example, we may collect personal information about consumers that is considered "protected health information" ("PHI") that we may receive from you, our clients including but not limited to health plan clients, self-insured employer clients,  clients, third-party administrators, health insurance plans, and health care providers such as health-systems, doctors, or pharmacies. PHI is governed by the privacy, security, and breach notification provisions of federal laws known as HIPAA (the Health Insurance Portability and Accountability Act of 1996, Public Law 104-191) and HITECH (the Health Information Technology for Economic and Clinical Health Act, Public Law 111-5), and their implementing regulations (Parts 160 and 164 of the Code of Federal Regulations). State law may provide additional requirements for PHI. This privacy policy does not cover PHI we collect about you. If you want to know how your health plan and their "business associates", and healthcare providers safeguard, use, and disclose PHI about you, ask your health plan and healthcare provider for their “Notice of Privacy Practices.”

Information Automatically Collected. Our Site, servers and third party service providers may automatically record certain information about how you use the Site, such as information about your device (phone, laptop, tablet, etc.), device identifiers, your Internet Protocol (IP) address, device and browser type, operating system, internet service provider, your mobile carrier, DNS, geographic or GPS information, purchase history, the frequency with which you use the Site, and other statistics and information. We may collect information about how you use our Site. We may use this information to gain a better understanding of the users of our Site, to improve our Site, and to improve our services. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies or block the use of other tracking technologies, some parts of the Site may then be inaccessible or not function properly.


How We Use Your Personal Information

You hereby consent to receiving print and digital communications from third party clearing houses (including Capital Rx) in connection with your use of the Site and the related services sought by you.



For Compliance, Fraud Prevention and Safety. We may use your personal information as we believe appropriate to:

  • protect our, your or others’ rights, privacy, safety or property (including by prosecuting and defending legal claims); 

  • protect, investigate and deter against fraudulent, harmful, unauthorized, unethical or illegal activity; 

  • comply with applicable laws, lawful requests and legal process, such as to respond to subpoenas or requests from government authorities; and 

  • where permitted by law in connection with a legal investigation. For example, we may share information with law enforcement to reduce the risk of fraud or if someone uses or attempts to use our Site for illegal reasons.


With Your Consent. In some cases, we may ask for your consent to collect, use or share your personal information.


How We Share Your Personal Information


We do not share your personal information with third parties without your consent, except in the following circumstances:


Company-Related and Affiliated Organizations. We may share your personal information with our affiliates and related organizations, if applicable, for use consistent with this Privacy Policy.

You hereby consent to the disclosure and processing of your personal information (including PHI) by third party clearing houses (such as Capital Rx) in connection with your use of the Site and the related services sought by you, or as required by applicable law.

Marketing. We may share your personal information to unaffiliated third parties for any of the purposes specified in this Privacy Policy. For example, we may hire a company to help us analyze our data or send information on our behalf about services in which you may be interested.


Security, Compliance, Fraud Prevention, Safety; Compliance with Law. We may disclose your personal information as we believe appropriate to government or law enforcement officials or private parties for the purposes described above under the following sections: For compliance, fraud prevention and safety and for compliance with law.


Business Transfers. We may sell, transfer or otherwise share some or all of our business or assets, including your personal information, in connection with a business deal  such as a merger, consolidation, acquisition, reorganization or sale of assets, or in the event of bankruptcy. 


Aggregated Use. We may disclose aggregated information about users of our Site, and information that does not identify any individual user.


Your State Privacy Rights


State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information, including the right to request a certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Your Choices


You can always choose whether or not to provide personal information on the Site. However, if you do not wish to provide the personal information identified in this Privacy Policy then you may not be able to utilize our Site. You can revoke your consent for us to use your information at any time by contacting us directly at the contact information below. If you revoke your consent, you will no longer be able to utilize our Site and we will promptly cease all use of your information.


Other Important Privacy Information


Security. The security of your personal information is important to us. We take a number of organizational, technical and physical measures that are designed to protect the personal information we collect. However, security risk is inherent in all internet and information technologies and we cannot guarantee the absolute security of your personal information. If we discover a security breach involving your personal information (as defined by the applicable state and federal laws) processed by us, we or your health plan will notify you, as required by law.


Verifying, Changing, and Deleting Your Information. If you have registered and/or enrolled for an account through our Site, you may update your profile information and change your communication preferences by contacting us directly at the contact information below. You can also request that we deactivate any account you have with us. 


Age Limitations. 

The Site is not intended for use by anyone under the age of 18. We do not knowingly collect or solicit personal information from anyone under the age of 18 unless such personal information is provided by the parent or legal guardian of a dependent under the age of 18. If you are under 18, you should not attempt to use the Site or send any information about yourself to us.

Third-Party Websites

If you interact with any third party, including through any application or content (including advertising) that may link to or be accessible from or through the Site, we are not responsible for any such third-party websites, content or services. Your use thereof may be subject applicable third party privacy policies and other terms. 


Do Not Track Disclosure

Some third-party sites do keep track of your browsing activities when they serve you content, which enables them to tailor what they present to you. We do not track Site users over time and across third party websites to provide targeted advertising and therefore our Site does not respond to Do Not Track (DNT) signals. 


Changes to this Privacy Policy 


We reserve the right to modify this Privacy Policy at any time. If we make changes to this Privacy Policy, we will post the updated policy on our Site. The date the privacy policy was last revised is identified at the top of the page. Your continued use of the Site after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.
